These Terms and Conditions (“Terms”) govern your use of the Arizona Strategy website (the “Site”) and any services provided by Arizona Strategy (“Arizona Strategy,” “we,” “us,” or “our”). By using the Site, requesting services, signing up for a monthly plan, or purchasing a retainer, you agree to these Terms.

Arizona Strategy is a marketing agency in Phoenix serving local businesses in the East Valley and throughout Arizona, and we also work with clients nationwide as an SEO agency and performance-focused growth partner.

1) Services We Provide

Arizona Strategy provides professional marketing services that may include:

• Search engine optimization (SEO) strategy and execution

• Paid advertising management (Google Ads and other platforms)

• Product marketing, go-to-market support, and positioning

• Conversion rate optimization (CRO), landing pages, and tracking setup

• Reporting, analytics, and performance recommendations

Services are delivered based on the plan selected, the agreed scope, and the priorities set during onboarding and ongoing communication.

2) Monthly Plans, Scope, and Time Allocation

Most monthly plans are structured around an expected delivery of up to approximately 16 hours per month (unless a different scope is agreed in writing). Because marketing is dynamic, the exact tasks and time allocation may change month to month based on what will most effectively improve outcomes.

You acknowledge that marketing services are not a physical product, and deliverables may include strategy, research, account changes, optimizations, reporting, and other intangible work product.

3) Client Responsibilities (Required for Results)

To do effective work, we may need access and inputs such as:

• Website CMS access (WordPress, Webflow, Shopify, etc.)

• Google Analytics / Google Search Console

• Google Business Profile access (if applicable)

• Ad platform access (Google Ads, Meta, etc.)

• Branding assets, offers, pricing, and approvals

Delays in access, approvals, or required materials can delay deliverables and affect timelines.

4) Billing, Renewals, and Payments

• Monthly services are billed in advance on a recurring basis unless otherwise agreed in writing.

• You are responsible for maintaining a valid payment method on file.

• Late or failed payments may pause work until the account is current.

5) Cancellations

For most clients on monthly service plans, you may cancel at any time by providing notice before your next billing date.

Some clients may be on a retainer, minimum-term agreement, or contract (special circumstance). If a signed agreement applies, its cancellation terms control.

6) Refunds

Refunds are addressed in our Refund Policy. In general, refunds are uncommon because services involve time and delivery of work product. In rare cases, a refund or credit may be considered if you were billed and no meaningful work was completed for that billing period, subject to our review and discretion.

7) Advertising Spend and Third-Party Costs

If we manage paid ads, you may incur third-party costs that are billed by platforms and vendors, including:

• Advertising spend (e.g., Google Ads)

• Software tools and subscriptions

• Hosting, domains, and other vendor services

These costs are not controlled by Arizona Strategy and are generally non-refundable through us.

8) No Guaranteed Outcomes (How Reality Works)

Marketing performance depends on many factors outside our control, including competition, budgets, seasonality, market demand, platform changes, website condition, and approval speed. Because of this, Arizona Strategy does not guarantee:

• Specific rankings (including “#1 on Google”)

• A fixed number of leads or sales

• Specific ROI within a set time period

We focus on strong execution, measurable improvements, and strategy that compounds over time—whether you hire us as an SEO agency or for digital marketing services more broadly.

9) Ownership of Accounts and Work Product

Unless otherwise stated in writing:

• You own your business accounts (Google Ads, analytics, etc.) when created under your credentials.

• You own deliverables you have paid for (reports, strategy docs, ad creative supplied by you, and content we deliver), except for any third-party licensed materials.

• We may retain internal processes, templates, and methods used to produce deliverables.

10) Confidentiality

We will treat your non-public business information as confidential and expect the same from you regarding our internal methods, pricing, and documentation unless disclosure is required by law.

11) Intellectual Property and Site Use

The Site and its contents (branding, text, design, graphics) are owned by Arizona Strategy or its licensors and may not be copied or reused without permission.

You agree not to misuse the Site, attempt unauthorized access, or interfere with its normal operation.

12) Limitation of Liability

To the fullest extent permitted by law, Arizona Strategy will not be liable for indirect, incidental, special, or consequential damages related to use of the Site or services. Our total liability for any claim related to services will not exceed the amount paid to us for the specific month or service giving rise to the claim.

13) Indemnification

You agree to indemnify and hold harmless Arizona Strategy from claims arising out of your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.

14) Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

15) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above reflects the current version. Continued use of the Site or services after changes means you accept the updated Terms.
